TeachMate ("the service") is provided by Dean Baptista ("we", "us", "our"), trading as TeachMate. By creating an account or using the service you enter into an agreement with Dean Baptista. Questions about these terms can be sent to teach.mate01@gmail.com.
By registering for, accessing or continuing to use TeachMate you agree to be bound by these terms. If you do not agree, please stop using the service. You confirm that you are of legal age to enter into this agreement, and where you sign up on behalf of a school or organisation, that you have authority to bind that organisation.
TeachMate is a subscription web application for teachers. It provides class scheduling and recurring timetables, student profiles and observations, lesson plans, assessment records, progress and after-class reports, a discipline log, teaching and finance records, notifications, and PDF/Excel exports. Features may be added, changed or removed over time.
You must provide accurate registration information and keep it up to date. You are responsible for keeping your password confidential and for all activity that takes place under your account. Tell us immediately at teach.mate01@gmail.com if you believe your account has been accessed without your permission.
You must not misuse the service. In particular, you must not:
You are responsible for the student and school information you enter, including having the right and any necessary permission to record it.
We grant you a limited, non-exclusive, non-transferable right to use TeachMate for the duration of your paid subscription or trial. All rights in the software, its design, documentation and branding remain owned by Dean Baptista. You retain ownership of the content you enter, and you grant us a limited licence to host and process that content solely in order to provide the service to you.
New accounts include a 7-day free trial. After the trial the service costs USD 12 per month and renews automatically until cancelled. You may cancel at any time, and access continues until the end of the period you have already paid for.
Payment, billing, tax, invoicing, cancellation and refund mechanics are handled by our reseller. Those mechanics are set out in Paddle's Buyer Terms, which apply to your purchase alongside these terms. See also our Refund Policy.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
We work to keep TeachMate available and reliable, but we do not guarantee that the service will be uninterrupted, timely, secure or error-free. Maintenance, third-party outages and factors outside our reasonable control may affect availability.
We may suspend or terminate your access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. Where it is reasonable to do so we will contact you first. You may stop using the service and cancel your subscription at any time. On termination you may request an export of your data within a reasonable period, after which it may be deleted.
To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where that exclusion is not permitted by law.
You agree to indemnify us against claims arising from content you upload, your unlawful use of the service, or your breach of these terms.
These terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction over any dispute. You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition or sale of assets. Neither party is liable for failure to perform due to events beyond its reasonable control. We may update these terms; material changes will be notified in the app or by email.
